UPDATE

Dear Shareholders:

We have received e-mails from a number of you regarding accounts with e-trade. We checked with our transfer agent and he assured us that all the shares with brokers have been transferred appropriately. The only potential issue are shorts. In any event, we are forwarding you an e-mail from from a fellow shareholder that may share some light on the situation.

Hi Don,

I wanted to thank you for the great job you have been doing and also wanted you to know about the latest issues with HVLN and etrade.

I just purchased 500 shares of HVLN in etrade and the stocks show up in my portfolio with a value and can be traded as normal, yet the previously owned shares still are not updated. I called etrade and they say that they are still waiting for the transfer agent to send them the shares. When questioned about this, all they could say is that they do not know why they have not received the shares.

It seems that they are indeed short and playing some sort of waiting game trying to get people impatient. They offered to "help" with the sale of the shares that are in Limbo (yeah, right!) but they tried to blame it on Harvard Learning Center as the reason why they do not have the older shares.
When asked if they had shorted the stock, they would not answer. They also would not confirm that the certificates were sent in.

When does the 13 day period for covering the short actually take effect, or are we already counting down? Any suggestions on what to do next to force the issue?
