Just from a financial need based decision I believe NWBO chose the path of least resistance. Having NASDAQ around their neck like a noose could hardly be seen as beneficial to their ongoing need for financing especially with the unwillingness of financiers to offer large enough amounts to sustain them for any substantial period of time. The issues you raise were themselves tied into a financial vehicle designed to allow Linda to self finance NWBO to maintain a controlling interest so obviously freedom to keep her options open would be a concern.
