FDA can drag it's feet on clearance because there is no pressure on them to do otherwise. The vast majority of the public don't know that Actipatch exists. So, that fact alone allows the FDA to reject BIEL's clearance requests with impunity. They know there will not be a backlash from the public, for the public is in the dark regarding this product. The sad and puzzling reality regarding this situation is BIEL seems to be cooperating with the FDA's behavior.
