The point I want to make is that this is not the trial. It is the preliminary discovery phase of the process. It is a response to IDCC interrogatories and the first dispositions.Of course, if NOK has no response then it is all over but I am sure that Nok will have some response. If the response is weak then IDCC can asked for a summary judgment. That is my understanding and I stand to be corrected.
