Their expert witnesses can't even present a favorable argument for them. And they are trying to get that theory by Dr. Puscnal into the court but it's highly doubtful that will make it. Read the final link on khenry's pacer reports yesterday. Chanbond destroyed their proposal to get that theory into the court. They basically just presented it as an expert witness in the end of expert discovery and didn't notify either Chanbond or the court that they were presenting a new theory so they left it to Chanbond to call them out for it. Then after being called out they tried to say Chanbond was not responding on time in reference to their other theories so that was why they deserve the right to bring this theory to the table. They also claimed that Chanbond changed direction on one of their claims when really their claims stayed true all throughout. That was another reason they decided they deserved the right to push this theory through. And pushing this theory through would be a big time prejudice against Chanbond considering they did not get the chance to hear the MSOs theories and present new claims to suppress their theories meanwhile granting this theory would do just that for the MSOs and give them a big time advantage.
