I think the Chanbond counsel is very stubborn in not allowing A new theory to be presented to the court. Judging off their response to the expert discovery they were very aggressive in getting the Judge to deny their new theory which was presented in expert discovery when they had months and months to bring this theory up in fact discovery. You dont get to the end of expert discovery and then just bring up a new angle that the opposition hasn't had a chance to articulate their own argument around that theory. They are out of line and deserve to be punished for doing so because they are disrespecting the courts procedures. I think as you said the Judge will be siding with us because its also just another ploy to delay so they have to go back to facr discovery and spend more time articulating arguments. Also the Judge will see how disrespectful they are and get rid of the nonsense.
