The MaxD and VLL appeals were lost. Those were the appeals of the judgment in favor of Google for compensation for MaxD’s infringement action, and VLL’s appeal of the decision of the patent office nullifying key claims in VLL’s patent (in which MaxD claims to own an interest).

Costs have also been awarded to Google against MaxD and VLL for the appeals.

There is no appeal of right of these decisions. If VLL or MaxD wishes to appeal, they would need to seek permission of the US Supreme Court. There’s virtually nil chance the Supreme Court would grant it.

The Attia lawsuit for theft of trade secrets may continue. The RICO claim was dismissed. Again. As expected. The order hasn’t been entered yet, I don’t think. Attia could appeal the RICO loss. Google had applied to have the whole claim including the trade secrets claim dismissed. Unsuccessfully. This means the original trade secrets might be pursued in state court if Attia wishes to. They were having a devil of a time identifying the allegedly stolen trade secrets, let alone valuing them, and so Attia may drop the claim. Google may also seek to appeal the decision declining to dismiss the whole claim as well. In the meantime, costs have been awarded to Flux Factory by the looks of it.
