Technically there is no Marta Claim until they refile their claim. I doubt the Marta attorneys even still represent or are retained by Marta anymore. I doubt anyone connected with Marta follows the case anymore. I do not think they are even on the Certificate of Service list of people to get copies of the filings. I suppose Rozen will motion the court to set a definite bar date for Marta to refile their claim . Or maybe a Motion to close the bankruptcy will be sufficient. It basically is Marta's responsibility to keep abreast of what is going on and maybe the bankruptcy will be closed before Marta knows Class 18 was next.
