It will be mandatory for an 8K to be issued when the company receives notice of the 298 events being reached. That is material information and they are not allowed to withhold that even if the data needs to be further validated. That caveat would be put into the 8K filing, otherwise they would be liable for a class action lawsuit for retaining material information.
