I agree fung. Judges are very focused on no mistrials, appeals and being overturned, on their record. It's appalling to me Dvorak's charges will be dismissed upon successful completion of his Probation Dept program. Which can take up to 18 months to complete after being accepted and he could practice law again. ugggh

The program consists of Community Service work and further/continued legal education into preventing the same circumstances from happening again.

The biggest problem was the government already had spent a bundle of taxpayers dollars with the almost 6 years successive grand juries into the Enterprise's 9 companies, extraditions, research, housing defendants in prisons and then private holding detention centers here for years. The Criminal Justice Act furnished (paid by taxpayer dollars) attorneys, for all defendants except Spooner and Dvorak.

DOJ big hammer cases success falling apart more, with each death of the 4 kingpins and left with the lowly 3 defendants no one cared about after Edwards' death. The last 3's worth reduced to zero at that point.

CMKM No longer feathers in caps, no promotions, no honorable award ceremonies, no big offers from the private sector, no piles of restitution cash able to be distributed to 40,000 shareholders.

They are satisfied with taking Turino off the streets for close to 7 years and Edwards who died remaining in federal custody for 8 years, 8 months.

The dollar cost of production for trial on 3 defendants reduced to everyday white collar riff raff and a media blip, expense of an expert securities witness proving no naked short at trial, why Turino, Kinney and Gutierrez folded, witnesses Steve Kirkpatrick and Leslie Hakala. Instead of an estimated over a 4 month trial, with dozens of witnesses, in the beginning.

Another wasted combined $105,000+ a year for 3 defendant's detention housing if convicted. Not worth it and again, no one cared anymore about those last lackluster 3. End Game. It's always about the money and politics and easiest plea deal but yet convictions.
