Question ... could POTN simply file BR on the the company that they are in the lawsuit with?

I know that it has been mentioned in the news that Trump has filed BR a few times with companies that are a part of his holding company and it had no affect on the parent company

If there are no assets in that company and only money owed ....
or
Why not offer to pay back original loan or simply file if they do not agree

When POTN took over the shell this should have been addressed
