I have to believe that Dowling and the attorneys at CVS I know what is necessary if there is a denial of patent. If it was requirement that something had to be filed and they didn’t file it how great could the penalty be? Probably close to nothing because it doesn’t materially affect the price of the stock.
stock price is based on earnings .
At worst perhaps a slap on the wrist but probably dismissed as frivolous. But you never know with a lawsuit
