No...the argument is that they did not report receiving a "final rejection notice", which everyone admits they had.

The current and pending status of a patent is never mentioned.

Fact:

A final rejection letter was received, determined by the language of the letter.

This was not reported to share holders.

It would seem the debate should be whether this is a material event, because the two events above DID happen.
