Thanks AZ, that is what I suspected. That means safe harbor has essentially given the earnings from the last 10 years, the same tax deferred advantage as a retirement account like a 401k -- the earnings from the previous years were able to collect more earnings without taxation until final safe harbir exit.

Maybe that is why the big boys like Bonderman is not making any fuss in the court about stopping the delays and getting this over sooner. The stock market has done well over the last few years. I always wondered if they wouldnt have wanted their money sooner...so why not file some motions to Walrath to end this sooner??

Maybe they realized that the tax deferred advantage of safe harbor is more beneficial and hence can earn more money the longer it lasts...so it was more advantageous financially to drag this out than to receive our money earlier, getting taxed, and reinvesting it post taxation.
