Based on the way it's worded, it sounds more like they are allowed to take the 5 million, but they may take less than that. Probably a take as needed type of thing.

The wording isn't completely bad.. my time off let's me take "up to" three weeks off at a time. That's different than my boss may let me take up to three weeks off.
