IMO, yes. The 13 can't determine their defense without it (I was there when they said it). The appeal is on claims on the core patent, so it's resolution is critical to getting an offer from them. If they lose, then they don't have much hope at trial. If they win, they have cracked the claims of the core patent. Both outcomes will decide whether they offer or take their chances at trial. Time for everyone to snooze, it's going to be a while before this is resolved.
