The Collateral Estoppel issue is based on whether Worlds is estopped from appealing the three IPR’s instead of all six IPR’s which all contained the RPI issue. The solicitor of the USPTO, it’s top lawyer and the official position of the PTAB has issued guidance in 2 cases that state the Collateral Estoppel does not apply to IPR’s in which the same issue has been raised in multiple appeals. The board would have to go against the solicitor of the USPTO. On remand the board meets with the solicitor and chief judge of the PTAB to review the remand which is a reprimand to the PTAB for not following the guidelines of the PTAB and directs the board on remand to comply with the CAFC’s guidance and USPTO rulings on collateral estoppel. Then the RPI review similarly based upon CAFC rulings and guidance.

When the CAFC vacated they reversed the IPR rulings therefore Worlds had all the claims reinstated dependent on the final board rulings.
