It turns out that the NJ Supreme court decision on gay marriage was by a vote of 5 to 4, and the 4 dissenting Justices wanted to grant gay marriage. The 5 who prevailed said that gays must have equal rights, but left it up to the NJ legislature to decide if it would be through marriage, or domestic partnerships. So all 9 Justices agreed that gays should have equal rights, but disagreed on how to achieve that goal.
