I think you can look at total revenues and base a 1% off it. Look at it this way, if the cable companies had done this legally they would have had to go through the patent owners first and establish a licensing deal. Now this is where Capitalism comes in. Obviously it’s the best thing out there or they wouldn’t all be using it. Who’s to say the patent owners wouldn’t have demanded much more than 1%? If cable company X comes up to 7% and cable company Y doesn’t, cable company Y has to use something inferior to cable company X until they’re willing to come up to 7%....

These patents held the power to shape the industry. They could have come with a high asking price. Now instead these companies will probably pay 1% in damages (of total revenues) with a 1-3% licensing deal to the patent’s applicable areas and to each cable company across the board, if they settle. I personally believe this is why they joined together in this lawsuit, everyone will get to see what everyone else is doing. Worst case (to the cable companies) they go all they way through the court system on this one and get slapped with treble damages and a licensing deal they know everyone else in the industry also has...
