Margaret Hamburg, MD, the former FDA commissioner, is accused of conspiring to suppress information about the harmful effects of Johnson & Johnson's antibiotic Levaquin--at the same time her husband ran a hedge fund that profited from J&J stock.


Nearly a year after Margaret Hamburg resigned as FDA commissioner, she is facing damning accusations in a federal lawsuit filed by a conservative, activist, government watchdog lawyer.

(April 3, 2017, 1:49 PM EDT) -- WASHINGTON, D.C. — A District of Columbia federal judge on March 31 dismissed a lawsuit filed by watchdog Larry E. Klayman alleging a conspiracy among Johnson & Johnson, former Food and Drug Administration Commissioner Margaret L. Hamburg and her husband’s hedge fund to hide the risks of the antibiotic Levaquin (Terry Aston, et al. v. Johnson & Johnson, et al., No. 16-86, D. D.C., 2017 U.S. Dist. LEXIS 49229).

In 2016, Terry Aston and four other individuals sued Johnson & Johnson, Hamburg and Renaissance Technologies LLC in the U.S. District Court for the District of Columbia. The plaintiffs alleged that the defendants conspired to “reap large financial returns by failing to disclose to Plaintiffs and the public at large the full extent of the devastating, life-threatening, and deadly effects of a highly dangerous drug named Levaquin.”

From the amended complaint:



During the confirmation process before Congress, Dr. Margaret A. Hamburg, acting in concert with her husband, Peter F. Brown and the other Defendants named in this Amended Complaint, at all material times the Co-CEO of a hedge fund named Renaissance Technologies, L.L.C., failed to disclose to Congress and other relevant authorities, her and her husband’s clear-cut conflict of interest –specifically, that Renaissance Technologies, L.L.C. held hundreds of millions of dollars of Johnson & Johnson stock, the manufacturer of the deadly drug, Levaquin. Once confirmed as FDA Commissioner, Dr. Margaret A. Hamburg acted as the instrumentality that all Defendants used to perpetrate their conspiracy and racketeering enterprise by having her act illegally and outside the scope of her authority as FDA Commissioner to suppress material information to Plaintiffs and the public that Levaquin was inherently dangerous and in fact, deadly. Had this information been disclosed to Plaintiffs and the public at large, her and her husband’s financial gain and net worth would have plummeted, since Dr. Margaret A. Hamburg’s husband, Peter F. Brown, reaped and continues to reap huge financial gain as a result of Renaissance Technologies, L.L.C.’s holdings of Johnson & Johnson stock. To further this conspiracy, Dr. Margaret A. Hamburg, acting in concert with each and every Defendant, jointly and severally, appointed officials of Johnson & Johnson to key FDA Advisory Committees and colluded with Johnson & Johnson and its officials and subsidiaries to suppress information about the dangerous and deadly effects of Levaquin. As a result, during Dr. Margaret A. Hamburg’s tenure as FDA Commissioner from 2009 to 2015, over 5,000 people died as a result of consuming Levaquin and other dangerous drugs promoted, manufactured, marketed, distributed and sold by Johnson & Johnson, suffered debilitating, life-threatening, and deadly illnesses and effects.

This deadly harm is continuing as Plaintiffs and thousands of other people are suffering and dying from the highly dangerous effects of Levaquin. Because of the Defendants’ racketeering scheme and conspiracy to suppress warnings and other material information about the extent of the deadly effects of Levaquin, Plaintiffs were precluded from discovering the extent of their injuries until 2015, not coincidentally after Dr. Margaret A. Hamburg no longer held her position as FDA Commissioner in 2015 and material information about the full extent of the dangers of Levaquin were disclosed thereafter. Given these harmful effects, Plaintiffs, all of whom were previously gainfully employed, suffered financial and other loss and damage to their persons, business, and property in the form of significant lost income since they could no longer continue to work, as well as harmful physical effects at Plaintiffs’ expense. Defendants, each and every one of them, profited handsomely from their racketeering conspiracy by their agreed-upon failure to disclose the harmful effects of Levaquin to Plaintiffs and the public at large. This case is thus of seminal importance not only for Plaintiffs, but also for the consuming public at large. It is a tragic testament to how corrupt companies like Johnson & Johnson and their officials bribe and illegally collude with government officials and line their pockets at the expense of persons such as Plaintiffs

Fluoroquinolones and Benzos:


In addition to being associated with other serious side effects such as the rupture of the Achilles tendon and retinal detachment, this class of antibiotics has impacts on the central nervous system and for this reason SHOULD NOT BE USED BY PEOPLE WHO ARE USING OR WHO HAVE WITHDRAWN FROM BENZODIAZEPINES. We do not have the information on their impacts on people using or withdrawn from other psychiatric drugs. There have been reports of people who have withdrawn from benzodiazepines for many months and have had a severe neuro-muscular or nervous system response (i.e. a return of withdrawal symptoms) after taking only a few of these antibiotic pills.

The FDA convened the expert advisory panel to review evidence on the safety of using fluoroquinolones to treat common infections. In the end, the 21-member panel voted overwhelmingly that, in most cases, the benefit of fluoroquinolones to treat bronchitis, sinus infections, and urinary tract infections was outweighed by rare, but serious harms, including irregular heartbeats, depression, nerve damage, ruptured tendons, and seizures.

Currently, those three illnesses account for nearly one-third of all fluoroquinolones prescribed outside of hospitals in the U.S. according to data presented by Janssen Pharmaceuticals, makers of Levaquin, at the FDA meeting. That overprescribing of the potent antibiotics is exposing patients to needless risk the panel concluded. While fluoroquinolones are essential for treating serious infections such as anthrax, for more common infections, other treatments typically work just as well with less risk.

Rampant Overprescribing
The new FDA ruling calling for restricted use of fluoroquinolones affects five prescription antibiotics: ciprofloxacin (Cipro), levofloxacin (Levaquin), moxifloxacin (Avelox), ofloxacin (Floxin), and gemifloxacin (Factive). All are also available as generics.

Much of the evidence on the risks of the drugs emerged after the drugs were on the market and used by millions of patients. While medical organizations such as the Infectious Diseases Society of America have updated their guidelines to advise against prescribing fluoroquinolones for milder garden-variety infections—including most cases of bronchitis, sinus infections, and urinary tract infections—many doctors haven’t gotten the message. That's likely because these powerful antibiotics work against a wide variety of bacteria, says Lindsey R. Baden, M.D., an infectious disease physician at Brigham and Women’s Hospital in Boston, Massachusetts, an associate professor at Harvard Medical School, and a member of the FDA panel. That can lead to overprescribing.
