You're right; the Flores settlement will come into play. Though the settlement was arrived at in 1997. God knows when the offenses described took place. (I'm sleepy; didn't read the whole thing.) It seems to me the horrific procedures described were developed over a long time.

The present situation--the separation of families--was very new, inflicted on these people by Trumpty. We don't yet know whether the same stuff was in use after only a short time.

But I'm sure we'll find out.
