What a bizarre press release.

It will be recalled that there were two motions. One, a motion to dismiss the RICO claims on the basis that the claims as stated did not give Attia a cause of action. Two, a motion to return the non-RICO claims to Santa Clara (state court) and split the lawsuit in two.

Attia (and its funder, former plaintiff MaxD) lost both motions. But you wouldn’t know that from this release.
