Whether there is any legitimacy to the law suit or not is unknown but one thing for sure the guys want be seeing shares or money any time soon. Have you ever been involved in a corporate law suit? Those things take years to work out. This is an event that will have zero impact on the current development in the company other than providing more bashing material. They might of been shorting the stock to hedge their profits. That's what most of the finance companies do.
