Thats a long long long shot. Worlds, Inc. WDDD used the same "privy" argument against Activision Blizzard's Developer Bungie Inc. The PTAB on Appeal "shot it down". This after Worlds presented as open evidence the Developer Agreement Activision signed with Bungie clearly stating that Activision had Legal review over all of Bungies patent review (to ensure Activsion wasn't infringing).

The PTAB isn't required to allow Discovery because its not a Title 3 Court, rather a Department of the Executive.

Worlds Appealed to the US Court of Appeals at the Federal Circuit. That one has been 2 years alone in process and close to a billion is on the line.

The point is Unified will likely not be allowed to produce discovery at the PTAB to maintain Cisco is in privy with Arris.
