The IR department is misleading you then. Here is why I can say that.

Let's say the OS was bumping up against the AS and the Board voted to increase the AS....but did not file the revised designation with the State.

Would the TA issue shares beyond the original AS? Answer: NO. Not until the designation was filed with the State as they would retain liability until then.

This question of the pref designation is no different
