I don't think they were aware of that at the time. Remember: they sued a day or two after DTCC debited their account. Clearly they felt they need to move quickly. Even before they'd figured out what had really happened, and certainly before getting a grip on their options.
Even after the lawsuit, they could have negotiated to retire the case in exchange for the request.
No, they couldn't have done that. The request had to be made by CRGP or someone representing CRGP. And "Adam Carter" had flown the coop. They tried to get the judge to appoint a receiver to reverse the dividend, but he declined to grant COR's motion
However, there are still many unanswered questions.
