Precedent Setting Action against BC Securities Commission, Barrick Gold, TSX and Others
May 31, 2017 - Mountainstar Gold Inc. (“the Company” or “Mountainstar”) is pleased to report that in a legal case determining major indemnification for damages in favour of Mountainstar’s client, Mr. Jorge Lopehandia, the case has successfully cleared the Supreme Court of Chile. It has now been remitted to the Minister of Foreign Affairs Chile for notification to Canada.
The significance of this action, aside from providing satisfaction for proven interim damages, also provides the last piece of legal evidence required by Mountainstar and its client, to obtain justice in Canada against Barrick Gold Corp.
The validation of Mr. Lopehandia’s rights to seek damages from, and to call to Chilean trials, the responsible parties for the Pascua Lama fraud, also validates the legal position of Mountainstar (formerly Mountain-West Resources (MWR)) from 2010 to 2017 in Canada.
Within the legal claim (under point 4) there is validation of a libelous publication against MWR which entitles Mountainstar to pursue its rights in Chile and Canada.
