Johnson: The worst case of failure of a corporate director. Just like Barrick v. Lopehandia is the seminal case of internet libel in Canada. This is going to turn out to be the seminal case illustrating a Canadian public company director's failure to excise the minimal amount of due diligence for a company and its shareholders.
The transcript of Johnson carrying out his star witness testimony is horrible. I can only think of what was going through the hearing panel's mind when Lopehandia went on and on and on. Loengandia's testimony was completely useless.
The reason the BCSC lawyer did not cross examine Lopehandia is that there was no need.
I feel sorry for the judges who will have to read Johnson written submissions. They better have Extra Strength Tylenol on hand.
