If the merger is not completed by the close of business on November 12, 2018 (which we refer to as the “end date”), the merger agreement may be terminated by either WMIH or Nationstar; provided, that if all of the conditions to closing have been satisfied or are capable of being satisfied at closing other than the condition that all regulatory consents, notices and approvals have been received, either WMIH or Nationstar may elect to extend the end date for one or more 30-day periods, not to exceed 90 days in the aggregate
