Regardless of CW. Eshoo's motives, she's getting the word out that we all knew, including Fibertower's management, that the spectrum was highly valuable. Fibertower made a good case for having earned an extension of the licenses, but they can not as easily counter a claim of 'constructive fraud' once the total transaction is brought to light. We can thank CW. Eshoo for saying $2 Billion.

Commissioner Clyburn is quite a respectable person, and did a great job during the short period of time she was acting Chairwoman of the FCC prior to Wheeler. She got a lot done in a short time.

Eshoo is wrong if she thinks this can just go back to auction status, because there are so many ways that would end up in courts. Also, I suppose the FCC could itself get locked in 'Stay' motions over the spectrum if they attempt to take it back. That take back doesn't seem likely, not if the goal is to be first in the world with 5G. China would love a 'take back' in the United States. It's too late to turn back.

I don't think the House Energy and Commerce Committee as a whole have the will to snarl this mess up any worse than it is now, so whatever Eshoo won't get the votes there.
