Your assumption is incorrect. The Court didn't review evidence in favor of Otiko. The Court DENIED Otiko's Motion to Dismiss for Failure to State a Claim. This means the Court found the claims to be credible. The only Motion Otiko prevailed on was for Jurisdiction. This is easily remedied by OPD by refiling in OK or CA, or SD if he only pursues the individuals.

If the court did review the evidence in favor of Otiko What is your point now you believe that it is a valid submision?
