Why would anyone think that in researching the case prior to ruling on the argument that the judge DID NOT consult with FINRA/SEC lawyers?

I'd say that argument is VERY unlikely!

It is OBVIOUS that the judge would have consulted with FINRA/SEC prior to the ruling...

So even an Email question seeking an opinion from them would have been just inconceivable? I'd say probable...
