I wanted to add, that this is between DNI a Canadian company, and Cougar an Australian company, so I am not sure if Cougar could even use a U.S. court, even if they wanted to, and IMHO, Cougar would probably have to use a Canadian court, or an Australian court. I also believe that courts in Canada and Australia are much stricter on companies completing the terms of their binding agreements which Cougar has not done, many times. Just IMHO.
