So, we got to the end of discovery last week.
They had a post-discovery conference last Monday
In that conference it was decided to move forward with "expert discovery". This is because there is science involved that the judge (and most of the rest of the world) is not familiar with or entirely able to understand.
Notably, the expert discovery phase now seems to revolve around the FTC trying to discredit IVDN's 2 expert witnesses. I have been told that one of these experts is a Nobel Laureate, so methinks the FTC is in for some tough sledding.
The next date on the docket is this Thursday, Nov. 30
This date represents both sides deciding whether they wish to request oral argument on IVDN's motion to disqualify the FTC's one "expert" witness, Dr. David Yarborough.
After that, IVDN must file their motion to disqualify by Jan 5, 2018, and the FTC has until Jan 26 to respond.
If oral argument on the disqualification is requested, it will likely take place the week of 2/5/18
IVDN's disclosure of their expert witnesses will take place by 2/20/18 and FTC's deposition of the experts shall take place by 4/16/18
After that there will be an post-expert discovery status conference on 5/2/18. NO EXTENSIONS OF EXPERT DISCOVERY ARE BEING ALLOWED.
The only thing after that would be a trial date, and the FTC would be fools to go forward with a trial, as the certain outcome of a trial would be a ruling WITH PREJUDICE against them, requiring them to pay ALL the court costs of BOTH sides, millions of dollars.
It was a valiant effort by the FTC to try to put this company out of business, thus saving the bacon of all the companies currently selling billions of dollars worth of shoddy house wrap.
Ultimately they will lose, and IVDN will have all their current and pending patents PROVEN out by this case, thus causing those patents to be worth untold amounts of money.

Patience. Things are about to get VERY GOOD around here!
