Your argument sounds logical but there is one flaw in your thinking. The black market won't be paying the taxes so there is no economy of scale that can beat that. The government will have their hand in every one's pocket from the producers to the retailers to the consumers.

One question. Are you currently a consumer? I don't think people will agree to pay more for being able to buy it legally. Once the consumer owns it, the freedom to smoke it or consume it will be legal no matter where they got it, right?

What you are banking on is the socially conscious, law abiding buyer when I believe that capitalism and the best deal will determine where consumers shop.
