Securities fraud cases for pinkies are handled by the State and they do follow through with prosecutions. I honestly don't know where BDGR registered their shares (TX or LA) but you can easily check the websites of the appropriate state agency to find out exactly what they consider securities fraud.

You are correct about the SEC. The only thing they'll do is refer you to their FAQ about investing in pinkies.

Many pinkies claim that they'll apply to another exchange. BDGR has taken this claim to another level.

BDGR is alomost too good to be true and maybe, just maybe, could be the one to escape pinksheet doom. I'm prepared for either scenario.
