I did not want to be tricky, but I could not express myself correctly / clearly every time (more precisely I thought I was clear).

Of course it is a scientific determination and (more likely) FDA won't conclude differently in case of these "DS", these won't be an exception.

However it will be a scientific determination in every cases: Could anybody (ITC) made a scientific determination (based on FDA decision / precedence) or not?

Meanwhile I hope (and still think it is the more likely scenario) the ITC will institute an investigation, I am not 100% sure ... due to the question above ... meanwhile the FDA (LOL) cited an ITC case which support the ITC institution of the investigation. (see #116199)
