Ziploc, Your points 2&3 seem most reasonable to me. They reinforce Nokia's position to cap all royalty payments at 5%. Point#1 seems less important to me because IDCC didn't violate any confidentiality agreement.
I am still in shock over Howard's unusual optimism over the future payments from Nokia and Samsung at the conference call announcing the ERICY agreement. I don't buy the argument that it was a ploy to cover up a poor agreement with Ericy. That doesn't ring true to me based on his traditional honesty and lawerly conservatism. I admit that he put his best foot forward with the announcement of the Nokia Samsung payments but that is what you expect from the CEO. We all wish he did more of it.
Finally, do you find it interesting that Samsung is lying low? Is that significant in any way or just Oriental face saving in case Nokia loses?
