Simple. There is the SEC and the Federal Court system where NASDAQ's decision can be appealed, overruled or remanded all while CYTR remains listed on NASDAQ. Once these avenues are exhausted, then yes, OTC would be CYTR's fate. BUT, that could take months, if not years, to play out. Read NASDAQ's Rules & Regs on the subject.

Besides, OTC would be a nice change of venue, if the alternative is keeping the status quo. 10 more days AGAINST R/S. Kman has a lot at stake, a lot more than me. He'll eventually come around. TYVM! ;p
