how could you make an exception for DS EE-EPA when FDA has previously determined that adulterated/synthetic compounds are by definition drugs, not DS?

(More likely) the DS EE- isn't an exception. FDA has already made determinations that synthetic substances are drugs ... however: Is it a scientific determination or not?
If not: ITC could apply and institute the investigation
If yes: it should be said by the FDA, for each of the product individually
