dwwedge; don't know really, maybe one of our attorneys can explain.

I think that the point is that NOK were not just a bystander to the lawsuit until 7/22/2003; they had been named on the docket for a reason and have been named for several years and Judges Sanders and Lynn would have been aware of NOK's interest in the case and settlement. JMO, JK
