You would have been absolutely right if they would have just announced it with a press statement.

Anavex made the "Potential for.. etc" material the moment they filed the 8K. If they just left it with a press announcement it would have been just that but they didn't.
Now they have to "8K-undo" it when it's not "Potential" anymore.
