Still missing the point.
Don't get me wrong. I too believe there is little chance. I am holding shares on a dream scenario, but it still does not answer parts of my original question.
If Asher owns the shares (which I do not believe), if there was no revenue to access, or if they honestly did not think they had a chance; why would they fight it?
This kind of legal fight spread over months will cost big.
Management would not spend that kind of money without some hope of light at the end of the tunnel.
It is extremely rare to come out of this situation but I am not a lawyer and do not know all the possible arguments.
