That is possible, the purchases from missling started on 8-11 and the patent issue notice wasn't until 8-16. Technically, missling put his purchase plan in place before being notified of the issuance, so insider trading would not apply to this possible news. If he had the issue date in hand and knew the issue date, then made the purchase...that would be different.
