I didn't know all of the minutia, but that pretty much sums things up as was my understanding. The point I was trying to make was that BK did not automatically mean that shareholders would be wiped out, but that it was not good either way.

This does raise an interesting question though. We're ALL waiting for topline PIII results on "L" now. What if NWBO actually did file for protection under these circumstances? It would take months to hash things out so, what happens if NWBO announces topline results that exceed expectations? What does a judge do in that case? I am only speculating, but suspect that he or she would order a continuance for x number of months and allow them (NWBO) to raise enough cash to settle with creditors. I have never heard of a case such as that scenario.
