The Judge in the KMART case has come out and stated HE MADE A TERRIBLE CALL IN THE CASE OF KMART and wished he had either never sat the case or had rendered a totally different ruling/decision..
And feels very bad what damage he cause to shareholders.

SO yes we all best hope for SPE's and off books assets!!!!!!!!!!!!!!

But plain and simple the DIPS in this case were NOT imho after ONLY THE NOL's PERIOD!!!!!!!!!!!!!!!!!!!!!!!!! But undisclosed value
