Very valid but like you said this is the very very worst case scenario. This case won't reach trial I'm willing to mark it. I asked my good friend who is in fact a patent lawyer to take a look at this case and he said that the chances of this making it to trial is slim to none because of what is truly at stake here. The magnitude of this technology impacts homes around the world and for it to be discovered as technology founded upon the infringement of a patent would shake not only the cable companies but that whole sector or market. They won't risk taking this trial because there is a high reward but a risk that is 1000x greater. And in addition PTAB ruled patents as valid which makes it even greater of a risk if it were to hit trial. CISCO wants this technology and they want it ASAP. I'm telling you as soon as one valid article is published about this case CISCO will settle/buyout so they can continue to use the technology and save the a** of the whole industry.
