1. Why the APR(absolute priority rule) was lifted after the 2-month GSA(global settlement agreement) ?

- So Commons could survive and receive a distribution

2. At the time of approval of lifting APR by Judge Mary Walrath, do you know what was in her mind regarding to potential assets returning to the debtors estate?

- No one other than the judge knows that. My opinion is that she thought it would be fair and allow ALL holders to benefit in some way.


3. If there is less than $10B in the final estate of debtors, why Mary approved ?

- Less than $10Bil under APR law would have resulted in Commons being wiped out. With the removal of APR, assets would be shared 75%/25% between Prefs and Commons after all other Creditors were paid in full.

4. Did Mary make a mistake for approving this?

- No. This was the most equitable outcome for everyone, especially Common shareholders.
