discovery is procedure. if it moves to trial they will use what was said in deposition. mainly, they want to see how good he answers his questions. is he eloquent, will he get nervous, is he believable. if he makes a great expert witness they will probably advise settlement. i am all for at least one of these companies going all the way. A settlement is not an admission of guilt. but a judgement says you lost. that is precedence. live to fight via settlements, but blow up with a win against all the other infringers.
