While we all know that settlement is highly probable, why is everyone expecting positive news on the 12th about a settlement?

As far as I can see, the joint report has to be submitted on that date and the report contains a question about prospective settlement discussions between the parties. Do we know, for sure, that the parties will disclose the fact that settlement is possible? Couldn't a party try to take a hard-line approach and answer the question in the negative? Are there any lawyers here familiar with this type of report and what the expectations are?

My only concern is that if there is no forthcoming settlement news around June 12th or, alternatively, if one of the parties (or both for that matter) take a hard line approach in the submissions, people here - who haven't been paying attention - will start freaking out.
